Tricky Wrongful Death Case Continues, Similar Cases Could Happen in Pennsylvania or Elsewhere

The Supreme Court of Missouri has just reinstated a wrongful death claim against a spine surgeon. This case of medical malpractice involved a patient that committed suicide allegedly because of the pain caused by his spinal surgery.

Philadelphia Police Catch and Arrest Woman in Hit and Run Car Accident

Philadelphia police have just arrested Crystal Tucker, 43, of Philadelphia. Tucker was seen by officers driving a 2001 Honda Civic in the area of Broad Street and Interstate 76 where she collided with another vehicle according to a CBS report.

Consent Decree by Medical Device Manufacturer Could Protect Philadelphia Residents

The U.S. Food and Drug Administration has just announced that Terumo Cardiovascular Systems Corporation (TCVS) has just signed a consent decree of permanent injunction. Two of the company's officers, Mark A. Sutter, president and CEO Mark Lincoln Vice President of Quality Assurance and Operations have had to personally sign the decree.

The consent decree will be filed in the U.S. District Court for the Eastern District of Michigan y the Department of Justice, Office of Consumer Litigation, and the United Sates Attorney's Office. It will prohibit the manufacturing, sale, and distributing of two heart-lung bypass systems and other cardiovascular devices to new customers.

A January through March 2010, FDA inspection revealed numerous cGMP and MDR violations at the company's Ann Arbor manufacturing facility. The violations included deficiencies in processes for corrective and preventive action, nonconforming product, complaints, purchasing, process validation, design controls, and adverse event reporting.
TCVS has previously profited $35 million for the sales of the devices. This amount will now be paid to the federal government. Additional disgorgement amounts will be charged should it fail to comply with the provisions of the consent decree in a timely manner.

Tragic Hit and Run Accident in Philadelphia

In a tragic case of hit and run, a Philadelphia bicyclist was seriously injured after being hit by a motorist this weekend. Meurig James, a Philadelphia area resident, is being called a "lucky" survivor of such a serious accident.

Mr. James is an award winning amateur cyclist who can no longer walk at this time. Philadelphia Victims Recall Deadly Duckboat Crash

A recent Philadelphia 6ABC report revisits the deadly Philadelphia Duckboat crash from the point of view of the victims and the tugboat driver. The July 7 crash in busy Philadelphia harbor killed two Hungarian teens and injured and terrified several other Duckboat riders.

According to the ABC 6 report, Ride the Ducks captain Gary Fox told investigators "Each time on that water is a new experience," after the Duckboat he was driving in July had been struck by another large vessel in the Philadelphia harbor.

The vessel, a 250 foot long (and 2,100 ton) city barge was picking up sludge and depositing it at a treatment plant further down the Delaware river, was eventually found to be partially to blame for the accident in conjunction with the tug boat that was responsible for towing the barge in the right direction.

The new ABC 6 report reveals that tug boat pilot Matt Devlin, had just learned that his young son had just suffered a life threatening reaction to anesthesia during eye surgery and had used his cell phone to make and receive 21 calls while at the wheel that day.

Defective Toys on the Legislative Radar, from Washington D.C. to Philadelphia

A bill was announced in Washington D.C. last December that would fine merchants who knowingly sell defective, recalled toys and would ban their use in day care facilities next year. Eight Obstetricians Within Hours of Philadelphia May Lose Malpractice Insurance

The Medical Liability Mutual Insurance Company is threatening to revoke and not revew insurance coverage for eight New York City area obstetricians. The obstetrician group which has been treating poor, high risk patients in and around the Bronx area for years, has been questioned on its methods and reportedly has been the brunt of many malpractice law suits.

Medical Liability Mutual Insurance Company issued a letter of warning to the group in a letter last month according to a New York Times report. An alarming eight of the 13 obstetricians of the Bronx-Lebanon Hospital Center will likely not have their malpractice insurance renewed. According to reports, the letter stated a "method of practice" among the eight doctors that made them an "unreasonable burden" to the insurance company and other policy holders.

The Bronx Lebanon hospital delivers about 2,700 babies each year and services many high risk patients including teenagers and women with diabetes, high blood pressure, and other medical problems.
