What Pennsylvania Parents Should Know about Birth Injury and Shoulder Dystocia

When it comes to birth injuries, many expectant parents think about cerebral palsy and other traumatic brain injury. It is, however, important to be aware of the several other conditions that could be caused at birth by negligent doctors, nurses, and other medical professionals. Infant Shoulder Dystocia is certainly something parents need to be aware of.

Shoulder dystocia occurs when poor fetal position or negligent delivery room error places large amounts of pressure on a baby's shoulder over an extended period of time. This excess pressure is the mechanism by which children suffer brachial plexus injury and resulting nerve damage. Brachial plexus injury has been known to cause Erb's palsy, a physical disability characterized by disfigurement, lack of development and lack of use of one arm.

Like Cerebral Palsy and other birth injury related conditions, Erb's Palsy can force a child to encounter a lifetime of physical, social, and financial difficulty. Sadly, Erb's Palsy is often a preventable birth injury, caused by unnecessary force during delivery. Cases of preventable birth injury have been seen far too many times in the Philadelphia area and all over the country. If you suspect that your child's disability may be the result of a preventable birth injury, contact a Pennsylvania birth injury lawyer of a Pennsylvania medical malpractice lawyer immediately.

Sadly, another Philadelphia toddler has suffered personal injuries after been struck by an oncoming motorist. This is the second report in a week of a toddler running into a Philadelphia street and being injured by a vehicle. The two cases are not related.

The driver, who was driving east bound near the 5500 block Wyalusing Avenue around 5 p.m. on Sunday, reports that he did not see the child running into the street. The two year old child was struck immediately, but remains in stable condition at the Children's Hospital of Philadelphia at this time. The driver of the vehicle has not reported any injuries.

It is unclear whether or not any charges will be pressed against the driver in this incident. The driver remained on the scene and cooperated with police before being allowed to leave the scene.

Parents are always advised to keep children from playing in or around roadways, especially on busy Philadelphia streets and drivers should always act as defensive drivers to avoid such incidents. If you or a loved one has been involved in a similar incident and it is unclear just who is to blame, contact a Philadelphia injury lawyer immediately. A Philadelphia injury lawyer will help explain your rights and see that you get any compensation that you may be owed for your case.

Remembering a Philadelphia Area Bus Accident

There has been a great deal in the news lately about charter bus accidents. Recent tragic accidents involving charter busses have sadly injured and killed many Philadelphia residents as well as citizens from surrounding cities.

Recent events make us take a look back at the tragic Septa Philadelphia bus crash of 2008. On September 13th of 2008 an overnight accident involving a Septa bus injured 20 people in West Philadelphia. The driver of a car traveling on 51st Street was said to have struck the Route 21 bus. The collision forced the bus to veer of the road and into a tree around the 5100 block of Chestnut Street.

After the crash, it was found that 20 people including the bus driver suffered mild to moderate injuries. Fortunately, in this case, none of the injuries were life threatening. The driver of the vehicle that struck the bus, who also suffered minor injuries, was charged with DUI after being treated at a Philadelphia area hospital.

In the case of a commercial auto accident, finding out who is responsible for compensation the victims so that their medical and financial needs are taken care of after the accident can be tricky. Similar complications could be seen in the recent Ride the Ducks accident in Philadelphia in which families of the victims filed suits against multiple parties involved.

Those who find themselves confused about who might be responsible for their injury can contact a Philadelphia injury lawyer. A Philadelphia injury lawyer will be will help you to decipher who just may be responsible.

Another Medical Product Recall Could Protect Philadelphia Residents

The U.S. Food and Drug Administration has announced that Terumo Cardiovascular Systems Corporation (TCVS) has finally signed a consent decree of permanent injunction. According to reports, the consent decree was filed in the U.S. District Court for the Eastern District of Michigan and the Department of Justice, Office of Consumer Litigation, and the United States Attorney's Office.

The consent decree will prohibit the manufacturing, sale, and distributing of two heart-lung bypass systems and other cardiovascular devices to new customers. The decree was filed after an FDA inspection spanning from January through March 2010 that surprisingly uncovered numerous cGMP and MDR violations at the company's Ann Arbor manufacturing facility.

These violations could cause serious injuries to patients in the Philadelphia Pennsylvania area and across the country. Violations included deficiencies in processes for corrective and preventive action, nonconforming product, complaints, purchasing, process validation, design controls, and adverse event reporting.

This decree is meant to protect residents of Philadelphia and hospital patients across the country. It is one of many in recent years that has stopped the sale of defective medical devices. If you or a loved one has suffered injury due to a faulty medical device or has been the victim of medical malpractice, contact a Philadelphia injury lawyer or a Philadelphia injury lawyer today.

How is Medical Malpractice Defined in Philadelphia?

Medical malpractice is defined as any act or failure to act by a health care professional diminishing or deviating the accepted standards of services and practices of the medical community. Some also define it simply as professional negligence.

As in every lawsuit, medical malpractice lawsuits are comprised of the plaintiff and the defendant. Medical malpractice lawsuits, however, are different than other law suits in a few distinct ways. This holds true in Pennsylvania and from state to state.

One major difference is that the cause might be more daunting and drawn out than a usual case. This is because it can sometimes be hard to prove whether or not medical malpractice really occurred. A successful case must prove that a legal duty of medical care and treatment was supposed to be undertaken by a health care officer or health care institution on the patient or plaintiff's behalf and wasn't.

For a medical malpractice case, the plaintiff will need a highly specialized lawyer such as a Pennsylvania medical malpractice lawyer. Pennsylvania medical malpractice lawyers know state law intimately and can help to navigate your case as smoothly as possible to reach a settlement.

In some medical malpractice cases, a power of attorney or loved one, may have to act on behalf the patient, who may have suffered death or debilitating injury due to the medical malpractice at hand. If you suspect you or a loved one has been the victim of medical malpractice, you'll need to act right away by taking the first step and calling a lawyer.

Wrongful Death Suit Filed Agasint Archdiocese of Philadelphia

The family of a Philadelphia, Pennsylvania man being only identified by the name "Ben" for reports, is suing the Philadelphia Archdiocese for wrongful death. The suit was filed last Wednesday in the Philadelphia Court of Common Pleas by Ben's family after a very heated allegation that the Philadelphia archdiocese covered up sex abuse cases, including that of their loved one.

Ben killed himself, according to family members, after he was told that his allegations of abuse by Philadelphia Archdiocese priest Rev. Joseph Gallagher were "not credible." Ben had previously filed a lawsuit against Rev. Gallagher alleging that he sexually abused him in the 1980s.

Although Rev. Gallagher was suspended in February, the archdiocese has declined to comment on either of the law suits. Ben's family is now hoping to receive compensation for damages due to wrongful death.

If you have suffered the loss of a loved one or family member that you suspect may have been the victim of wrongful death in the Pennsylvania area, contact a Philadelphia accident lawyer as soon as possible. A Philadelphia accident lawyer will ensure that any case you have will be heard as soon as possible in order to avoid any statutes of limitations and to ensure your family gets what they deserve in a timely manner.

Teacher Injured by Student While Working at Philadelphia School

A court is hearing testimony this week after a teacher has been pummeled and injured by a student at a Philadelphia alternative school. According to reports, two older students are being held for trial on charges that they attacked their teacher at the Excel Academy. Excel is an alternative school in Northeast Philadelphia.

After the alleged attack, the teacher had to be hospitalized and was eventually released in good health. While the defendants remain in custody, Prosecutor Erica Rebstock says the attack by the students that wrongfully injured the teacher was unprovoked.

The defendants, 20-year-old Terrell Carter and 19-year-old Bryan Pressley allegedly attacked the teacher who was returning to class from lunch. Terrell Carter "comes from behind, reaches into his lunch bag. The teacher removes his hand and then Terrell Carter punches him very forefully in the back of the knee." Carter's attorneys are saying his client will plead not guilty, while Pressley's attorney's declined to comment to CBS Philadelphia yesterday evening.

Situations were workers are put in harms way at work needlessly and suffer wrongful injury on the job are both common and unfortunate. It is important that if this has happened to you or a loved one that you find out what you may be entitled to. Contact a Philadelphia injury lawyer or a Philadelphia accident lawyer immediately.
